What the rule requires

From 1 Aug 2030, every toy model placed on the EU market needs a digital product passport, reached through a data carrier on the toy, its packaging or its documents. Its identifier must be uploaded to the ESPR registry before the toy goes on sale. The carrier technology is not fixed in the regulation and is left to Commission delegated acts, so RFID or NFC could qualify alongside QR.

Status: Adopted; in force since 1 Jan 2026; applies, including the DPP, from 1 Aug 2030

What it means for RFID

The toy regulation requires a data carrier, not RFID. Every toy model needs a digital product passport (DPP) reached through a carrier on the toy, its packaging or its documents, and the choice of carrier is left to Commission delegated acts, so RFID or NFC could qualify alongside QR codes.

The obligation falls on toy makers and importers, who must also upload each passport's identifier to the ESPR registry before the toy goes on sale. For tag and label suppliers, the opening depends on what the delegated acts allow; the sources do not yet name a tag type or frequency.

The regulation has been in force since 1 January 2026, and the DPP applies from 1 August 2030, when it replaces the declaration of conformity and the Toy Safety Directive 2009/48/EC is repealed. The delegated acts on the carrier are the thing to watch before then.
